Please read these Terms and Conditions carefully before using our application. By creating an account or using our services, you agree to be bound by these terms. If you do not agree, please do not use the app.

2. Your Account

Age Requirement

You must be at least 18 years old to create an account and use this application. By registering, you confirm that you meet this requirement.

Account Security

You are responsible for keeping your login credentials confidential. You agree to:

• Choose a strong, unique password
• Not share your account with anyone else
• Notify us immediately at jessica@mybuildsmart.com if you suspect unauthorized access

We are not liable for any loss or damage resulting from unauthorized access to your account due to your failure to keep credentials secure.

Suspension and Termination

We reserve the right to suspend or permanently terminate your account at our sole discretion if we believe you have violated these Terms, engaged in fraudulent activity, or used the app in any way that could harm other users or our business. We will make reasonable efforts to notify you before taking such action.

Free Trial

We offer a 7-day free trial for new users. The following conditions apply:

• The free trial begins on the date you create your account
• No payment information is required to start the trial
• After the 7-day trial ends, continued access requires a one-time payment of $39 plus applicable tax
• You will be prompted to enter payment information through a paywall once your trial has expired
• Trial access is available to new accounts only and may not be used more than once per person

3. Payment Terms

Pricing

Access to the full application requires a one-time payment of $39 plus applicable tax. This payment is collected after your 7-day free trial ends, when you choose to upgrade through the in-app paywall.

Billing

Payment information is only collected when you choose to upgrade after your trial. By providing your payment information at that time, you authorize us to charge your payment method for the one-time fee of $39 plus applicable tax.

Refund Policy

All sales are final. We do not offer refunds once payment has been processed. If you believe there has been a billing error, please contact us at jessica@mybuildsmart.com within 7 days of the charge.

Payment Processor

All payments are processed securely through Stripe. We do not store your full credit card details on our servers. By making a payment, you also agree to Stripe's terms of service.

Chargebacks & Disputes

If you have a concern about a charge, please contact us before initiating a chargeback with your bank. All billing disputes will be handled through Stripe's standard dispute resolution process. Initiating a fraudulent chargeback may result in account termination.

4. Intellectual Property

All content within this application — including but not limited to software, design, text, graphics, calculators, and data — is owned exclusively by My Build Smart and protected by applicable copyright, trademark, and intellectual property laws.

You agree NOT to:

• Copy, reproduce, or duplicate any part of the app
• Resell, sublicense, or distribute access to the app
• Use any content from this app for commercial purposes without written permission
• Remove or alter any proprietary notices or labels

5. Acceptable Use

You agree to use this application only for its intended purpose and in compliance with all applicable laws. The following activities are strictly prohibited:

• Attempting to hack, breach, or circumvent any security features
• Reverse engineering or decompiling any part of the software
• Sharing your account login with others
• Scraping, harvesting, or extracting data from the app through automated means
• Uploading or transmitting malicious code or content
• Using the app to engage in any fraudulent, illegal, or harmful activity

Violation of these rules may result in immediate account termination without refund.

6. Important Disclaimers

We strongly encourage all users to consult with licensed financial advisors, mortgage professionals, contractors, or other qualified professionals before making any financial or construction-related decisions.

7. Limitation of Liability

To the maximum extent permitted by law:

• The application is provided "as-is" and "as available" without warranties of any kind, either express or implied
• We do not guarantee the accuracy, completeness, or reliability of any information, estimates, or calculations produced by the app
• We are not responsible for decisions you make based on information provided by the app
• Our total liability to you for any claim arising out of your use of the app shall not exceed the amount you paid to us in the 12 months preceding the claim
• We are not liable for any indirect, incidental, consequential, or punitive damages

8. Changes to the App and These Terms

We reserve the right to modify, update, or discontinue any part of the application at any time without prior notice. This includes adding or removing features, changing pricing for future users, and updating these Terms and Conditions.

If we make material changes to these Terms, we will notify you by email or by displaying a notice within the app. Your continued use of the app after any changes constitutes your acceptance of the updated Terms.

Information We Do NOT Collect

We do not collect your Social Security number, government-issued ID, credit reports, or detailed financial records. Any financial or construction figures you enter into the app's calculators are processed in your session and are not stored or linked to your identity.

Payment Information

We do not store your credit card number, expiration date, or CVV. All payment data is handled directly by Stripe, our payment processor. We only receive a confirmation token and the last four digits of your card for billing reference purposes.

Automatically Collected Information

When you use the app, we may collect basic technical information such as your IP address, browser type, and general usage patterns. This is used solely to maintain app security and performance.

3. How We Use Your Information

We use the information we collect only for the following purposes:

• To create and manage your account — your name and email are used to identify you and provide access to the app
• To process payments — your email is shared with Stripe to send receipts and manage billing
• To communicate with you — we may send you account-related emails such as trial reminders, billing confirmations, and important policy updates

We do not use your data for advertising, and we do not sell your information to third parties.

We do not sell, rent, or trade your personal information. The only third party we share data with is:

Stripe

We use Stripe to process payments securely. When you make a payment, your name and email are shared with Stripe as part of the transaction. Stripe operates under its own Privacy Policy, which you can review at stripe.com/privacy. Stripe is PCI-DSS compliant and does not receive any financial or project data you enter into the app.

We do not use any other third-party analytics, advertising, or marketing tools at this time.

5. Data Storage and Security

Your data is stored on secure servers. We take reasonable technical and organizational measures to protect your information from unauthorized access, loss, or misuse, including:

• Encrypted data transmission (HTTPS/TLS)
• Secure password storage using industry-standard hashing
• Access controls limiting who on our team can view user data

No method of transmission or storage is 100% secure. While we work hard to protect your information, we cannot guarantee absolute security.

We retain your name and email for as long as your account is active. If you stop using the app, we may retain your information for a reasonable period for legal, billing, or dispute resolution purposes.

• Account Deletion — we are actively building a self-serve account deletion feature.
